Probate Litigation
The statutory probate courts of the larger Texas counties, including Dallas, Tarrant, Denton, Bexar, and Harris Counties as well as others, have broad jurisdiction to hear a wide range of matters. In these counties probate lawsuits can come in all shapes and sizes including:
• will contests;
• heirship proceedings brought to establish
inheritance rights;
• claims by beneficiaries against executors or
administrators to recover their rightful portion of an
estate;
• claims by ex-spouses for child support and
maintenance;
• claims against the estate by other creditors of the
deceased;
• suits to remove an executor or administrator;
• wrongful death, survivorship, and other tort claims;
• suits to create or modify a guardianship; and
• many other lawsuits that may be related to an estate
or guardianship proceeding.
Probate litigation often means a will contest. Wills may need to be contested for many reasons including incapacity of the testator, undue influence exerted by someone to coerce the testator into signing a Will, or a myriad of other reasons. Sometimes a lawsuit needs to be brought in a probate matter simply because a beneficiary is not being treated fairly, and they don't know what else to do. But the Texas probate courts can help.
Often times, other courts may have concurrent jurisdiction over some of these claims as well. Even though some of these matters may be brought in district or county courts, if the matter is pending in, or may be transferred to a probate court, then a lawyer with specific experience in probate litigation should be consulted.
